Terms and Conditions of Sale

These Terms govern all purchases made through this website from Mademoiselle Spends SAS, registered with the Paris Trade and Companies Register under number 988 137 642, whose registered office is at 229 rue Saint-Honoré, 75001 Paris, France, contact: [email protected]. Any purchase implies full acceptance of these Terms. Purchases are reserved for individuals aged 18 or over.

Products

Mademoiselle Spends offers two products. The membership (The Elegance Makeover) is a recurring subscription giving access to the online courses, the private community, group sessions and educational resources on the online platform. The one-to-one programme is a personalised service delivered remotely or in person over the period agreed at the time of purchase, and includes access to the online courses, the private community and all membership resources for the duration of the collaboration. Certain products are governed by specific terms presented at checkout. In case of conflict, the specific terms prevail over these general Terms for that product.

Prices and payment

Prices are indicated in euros and are all-inclusive: the price displayed is the price charged, with any applicable VAT included. No additional taxes or fees are added at checkout, whatever the client's country of residence. A purchase is confirmed only once full payment, or the first instalment, has been received. Payments are processed by secure third-party providers; Mademoiselle Spends does not store payment card details.

Membership

The membership is billed automatically at the interval stated at checkout (monthly unless otherwise indicated) and renews automatically until cancelled. By subscribing, the client authorises the recurring payment. The client may cancel at any time from their account settings or by contacting [email protected]. Cancellation stops future billing; access continues until the end of the current billing period. No refund is issued for partially used billing periods or for renewal payments. Failure to complete a payment may result in suspension or termination of access. Mademoiselle Spends may update, replace or reorganise course content, session formats and schedules at any time.

One-to-one programme

The one-to-one programme is tailored to the client's situation and delivered according to the format, duration and schedule agreed at the time of purchase. Access to the online courses and the community is granted upon payment and ends when the collaboration ends, unless the client holds an active membership. Cancellation and rescheduling conditions for individual sessions are specified at the time of purchase. Late cancellations or failure to attend may result in the session being considered delivered and non-refundable. Fees paid for the programme are not refundable once the collaboration has started.

Right of withdrawal

In accordance with Article L221-18 of the French Consumer Code, the client has a right of withdrawal of 14 days from the conclusion of a distance contract, subject to the exceptions below.

Membership. The courses, community and resources included in the membership are digital content supplied without a physical medium, made available immediately upon payment. By completing the purchase, the client expressly requests immediate access to the content and acknowledges that, in accordance with Article L221-28 13° of the French Consumer Code, the right of withdrawal is lost once access has been granted. No refund is issued after purchase.

One-to-one programme. By completing the purchase, the client expressly requests immediate access to the digital content included in the programme and requests that the service begin before the end of the withdrawal period. The client acknowledges that the right of withdrawal is lost once access to the digital content has been granted (Article L221-28 13°) and, as regards the personalised service, once it has been fully performed (Article L221-28 1°). If the service has begun but not been fully performed, the amount corresponding to the part already delivered remains due.

Client responsibility and conduct

The client agrees to provide accurate and complete information necessary for the delivery of the service, to keep their login details confidential and not to share access with others. Within group sessions and the community, the client agrees to interact respectfully with other members and to refrain from disruptive, inappropriate or harmful behaviour. Mademoiselle Spends reserves the right to refuse or terminate access to a client whose behaviour disrupts the sessions, the community or the experience of other members; in that case access may be removed without prior notice and no refund is issued for the remaining period.

Intellectual property

All content provided by Mademoiselle Spends, including course material, session recordings, documents, frameworks, lookbooks and resources remains the exclusive intellectual property of Mademoiselle Spends SAS. The client receives a personal, non-exclusive and non-transferable right of use for private purposes only. Content may not be copied, recorded, shared, resold or distributed, in whole or in part, without prior written consent. Any infringement may be pursued through all available legal remedies.

Recording of group sessions

Live group sessions may be recorded and made available to members as replays on the online platform. Recordings may be retained and accessible for future reference. Mademoiselle Spends may use excerpts of these recordings for communication, educational or promotional purposes, including on the website, social media and marketing materials. A client who does not wish to appear in such materials, or who wishes their image, name or contributions to be limited (for example, by blurring their face or anonymising their participation), may notify Mademoiselle Spends at the time of purchase or by contacting [email protected]. Reasonable efforts will be made to accommodate such requests.

Reviews

Clients may be invited to submit a review. Reviews are collected for publication: by submitting a review, the client agrees that it may be published, together with the first name and community photo, on the website, social media and any other communication media of Mademoiselle Spends. Reviews may be shortened or edited for length, without altering their meaning. The client may request at any time that her first name and photo be removed from her review by contacting [email protected]; the review may then remain published in anonymised form.

Testimonials

Following the delivery of a service, Mademoiselle Spends may invite the client to provide a testimonial. By submitting a testimonial, the client grants Mademoiselle Spends the right to reproduce, publish, and adapt it for communication, marketing, or promotional purposes, on the website, social media, and any other media. Testimonials are published using the client's first name only, unless another form of identification is expressly agreed.

Use of communications and content

By purchasing a service, the client acknowledges that messages, emails, feedback, results, and any other communications exchanged with Mademoiselle Spends, before, during, or after the delivery of a service, may be used by Mademoiselle Spends for marketing, promotional, educational, and commercial purposes, including but not limited to website content, social media, newsletters, case studies, press, and presentations. Such content will be anonymised by default. Identified use requires the client's express agreement. The client may object to this use at any time by contacting [email protected]. Objections apply going forward and do not affect content already published in anonymised form.

Results variation

Results may vary from one client to another. Any examples of progress or outcomes are provided for illustrative purposes only and reflect clients who are highly committed, consistent, and fully engaged throughout the process. Actual results depend on multiple factors including the client's level of engagement, consistency of implementation, personal circumstances, and external variables beyond the control of Mademoiselle Spends. No specific outcome or timeframe can be guaranteed.

Confidentiality

Sensitive personal information shared specifically for the purpose of delivering a service, such as financial details, health information, or business-sensitive data, is treated as confidential and is not disclosed to third parties or used for purposes other than service delivery. Group sessions and the community are shared environments; while discretion between members is expected, full confidentiality of information shared there cannot be guaranteed. General communications, feedback, and results are subject to the Use of Communications and Content clause above.

Personal data

Personal data is processed in accordance with the Privacy Policy available on this website.

Liability

Services consist of advice, guidance and educational content. Mademoiselle Spends cannot be held responsible for decisions or actions taken by the client following the delivery of a service, nor for temporary unavailability of the online platform due to maintenance or causes beyond its control.

Modifications

Mademoiselle Spends may update these Terms at any time. The Terms applicable to a purchase are those in force on the date of purchase; for the membership, continued use after notification of updated Terms constitutes acceptance.

Applicable law and disputes

These Terms are governed by French law. In the event of a dispute, the client is invited to contact [email protected] to seek an amicable resolution. Failing amicable resolution, the client may bring a claim before the competent court of their place of residence or before the competent courts of Paris, at their choice.
